Where applicable, we may collect photographs, video recordings, audiovisual recordings, or other media in which you may appear while attending or participating in our events, subject to applicable law and any separate terms, waivers, or media releases applicable to the event.
In addition to the information you voluntarily provide, Courtside Society may automatically collect certain technical and usage information when you access or use our website. Such information may include your Internet Protocol (IP) address, browser type and version, device identifiers, operating system, language preferences, website usage data, referring and exit pages, pages visited, the date and time of access, the duration of your visit, clickstream data, log file information, and information collected through cookies, pixels, and similar tracking technologies.
Courtside Society may also collect personal information from third parties where authorized by you or where otherwise permitted or required by applicable law.
Use of Personal Information
Courtside Society uses personal information only for purposes that are reasonable in the circumstances, consistent with the purposes for which the information was collected, and otherwise authorized or required by applicable law. We will not use your personal information for purposes that are materially different from those described in this Privacy Policy without providing notice and obtaining any consent required by applicable law.
Personal information collected by Courtside Society may be used to establish, administer, and maintain our relationship with you; process ticket purchases, registrations, reservations, waitlists, and other transactions; administer, organize, coordinate, and facilitate events, tournaments, promotions, contests, and related services; verify your identity and confirm your eligibility to participate in particular events or activities where required; and communicate with you regarding registrations, purchases, confirmations, schedule changes, cancellations, customer support matters, safety notifications, and other service-related communications.
Where you have provided your consent, or where otherwise permitted by applicable law, we may use your personal information to send newsletters, promotional materials, event announcements, exclusive offers, surveys, and other marketing communications relating to Courtside Society's events, products, and services.
Personal information may also be used to personalize and improve your experience with our website, events, products, and services; operate, maintain, monitor, troubleshoot, secure, and improve our website, digital platforms, and technological infrastructure; analyze website traffic and user engagement; conduct research and analytics; evaluate and improve our events, services, marketing initiatives, and business operations; and maintain the safety, security, and integrity of our website, events, systems, personnel, guests, and business operations, including detecting, investigating, preventing, and responding to fraud, unauthorized access, cybersecurity incidents, unlawful activity, and violations of our policies.
Where reasonably necessary, Courtside Society may use personal information to establish, exercise, or defend legal rights or claims; enforce these Terms and Conditions, our Event Waiver, and other agreements governing our relationship with you; protect the rights, property, safety, and legitimate interests of Courtside Society, our employees, volunteers, contractors, sponsors, partners, guests, and the public; recover outstanding debts; and comply with applicable laws, regulations, court orders, legal proceedings, governmental requests, insurance obligations, accounting requirements, and other regulatory or compliance obligations.
Courtside Society may also use personal information for any other purpose to which you have consented or that is otherwise authorized or required by applicable law.
Where personal information is reasonably required to provide a requested product, service, registration, or event experience, your decision not to provide such information may prevent Courtside Society from processing your request or providing some or all of the requested services.
Disclosure of Personal Information
Courtside Society does not sell, rent, or otherwise disclose your personal information to third parties except as described in this Privacy Policy, with your consent, or as otherwise authorized or required by applicable law.
In the ordinary course of our business operations, Courtside Society may disclose personal information to trusted third-party service providers who perform services on our behalf or assist us in delivering our products, services, and events. Such service providers may include payment processors, ticketing and registration platforms, website hosting providers, cloud storage providers, information technology service providers, customer relationship management providers, email and marketing platforms, analytics providers, event management vendors, and other professional service providers. These third parties are authorized to access personal information only to the extent reasonably necessary to perform the services for which they have been retained and are contractually or otherwise legally required to protect the confidentiality and security of such information.
Courtside Society may disclose personal information to its professional advisors, including legal counsel, accountants, auditors, insurers, financial institutions, and other consultants where such disclosure is reasonably necessary for the administration of our business, the provision of our services, the management of legal or financial matters, or the protection of our legal rights and interests.
Personal information may also be disclosed where Courtside Society believes, in good faith, that such disclosure is necessary or appropriate to comply with applicable laws, regulations, court orders, subpoenas, search warrants, governmental requests, or other legal processes, or to establish, exercise, or defend legal claims. We may also disclose personal information where necessary to investigate, prevent, or respond to suspected fraud, unauthorized access, cybersecurity incidents, unlawful activity, violations of our Terms and Conditions or Event Waiver, or circumstances involving the protection of the rights, property, safety, or security of Courtside Society, our employees, volunteers, contractors, sponsors, guests, event participants, or the public.
Where Courtside Society undergoes or contemplates a business transaction, including a merger, acquisition, corporate reorganization, financing, sale of assets, or other change in ownership or control, personal information may be disclosed to prospective purchasers, investors, lenders, legal advisors, or other parties involved in the transaction, provided that such information is disclosed only to the extent reasonably necessary for the purposes of evaluating or completing the transaction and subject to appropriate confidentiality obligations or as otherwise permitted by applicable law.
Courtside Society may also disclose personal information where you have expressly authorized or directed us to do so, or where such disclosure is otherwise permitted or required by applicable law.
Where personal information is disclosed to third-party service providers, Courtside Society takes reasonable contractual and organizational measures to ensure that such information is protected and handled in a manner consistent with this Privacy Policy and applicable privacy legislation. However, where personal information is processed by a third-party service provider, it may be subject to the laws of the jurisdiction in which that service provider operates and may be accessible to courts, law enforcement agencies, or other governmental authorities in accordance with those laws.
Reservation of Rights and Compliance with Applicable Law
The Participant acknowledges and agrees that Courtside Society conducts its business and operates its Events in accordance with all applicable federal, provincial, and municipal laws. The Participant further agrees to comply at all times with all applicable statutes, regulations, municipal by-laws, venue policies, licensing requirements, responsible liquor service requirements, age verification procedures, occupancy limits, health and safety requirements, emergency procedures, and all lawful instructions issued by Courtside Society, the venue owner or operator, security personnel, event staff, emergency responders, or any governmental or regulatory authority having jurisdiction over the Event.
Where alcoholic beverages are available at an Event, the Participant acknowledges and agrees that the sale, service, possession, and consumption of alcohol shall at all times be subject to the Liquor Licence and Control Act, 2019, its regulations, and all applicable policies, standards, and directives of the Alcohol and Gaming Commission of Ontario (“AGCO”), together with any applicable venue policies and procedures. The Participant agrees to comply with all responsible liquor service requirements, to provide valid government-issued photo identification upon request for age verification purposes, and to refrain from providing or attempting to provide alcoholic beverages to any person who is under the legal drinking age or who is, or appears to be, intoxicated or impaired. The Participant further acknowledges that the consumption of alcoholic beverages may impair judgment, coordination, reaction time, and physical abilities and voluntarily assumes all risks associated with the Participant's own consumption of alcohol before, during, or after the Event.
Without limiting any other provision of these Terms and Conditions or this Waiver, Courtside Society expressly reserves all rights, remedies, protections, defences, immunities, and entitlements available to it under applicable law, including, without limitation, the Occupiers' Liability Act, R.S.O. 1990, c. O.2, the Trespass to Property Act, R.S.O. 1990, c. T.21, the Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A, the Electronic Commerce Act, 2000, S.O. 2000, c. 17, the Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5, Canada's Anti-Spam Legislation, S.C. 2010, c. 23, the Competition Act, R.S.C. 1985, c. C-34, the Liquor Licence and Control Act, 2019, S.O. 2019, c. 15, Sched. 22, the Fire Protection and Prevention Act, 1997, S.O. 1997, c. 4, the Building Code Act, 1992, S.O. 1992, c. 23, the Criminal Code, R.S.C. 1985, c. C-46, together with all other applicable statutes, regulations, municipal by-laws, licensing requirements, common law principles, equitable remedies, governmental directives, and lawful orders applicable to the Event, the venue, or the operations of Courtside Society.
Nothing contained in these Terms and Conditions or this Waiver shall be interpreted as limiting, excluding, waiving, or otherwise prejudicing any statutory, contractual, common law, or equitable right, remedy, defence, immunity, privilege, or protection available to Courtside Society. All rights and remedies available to Courtside Society shall be cumulative and may be exercised concurrently or independently, and the exercise of any one right or remedy shall not preclude the exercise of any other right or remedy available at law or in equity.
Courtside Society expressly reserves the right, in its sole and absolute discretion and without liability or compensation except where required by applicable law, to refuse admission to, deny entry to, suspend, remove, or permanently exclude any Participant whose conduct is unlawful, unsafe, disruptive, threatening, abusive, harassing, discriminatory, violent, or otherwise inappropriate, or who is intoxicated, apparently intoxicated, impaired by alcohol or drugs, refuses to comply with responsible liquor service requirements or age verification procedures, attempts to provide alcohol to a minor or an intoxicated person, possesses prohibited substances or weapons, damages property, endangers the safety or security of any person, or otherwise acts in a manner that is inconsistent with these Terms and Conditions, the Event rules, venue policies, or the safe and orderly operation of the Event. Courtside Society further reserves the right to refuse or discontinue alcohol service to any Participant where required or permitted by applicable law or where Courtside Society, acting reasonably, considers such action necessary to protect the safety and well-being of attendees, staff, contractors, volunteers, or members of the public.
The Participant acknowledges and agrees that any breach of these Terms and Conditions, this Waiver, applicable law, venue policies, or lawful directions issued by Courtside Society or the venue may result in immediate removal from the Event without refund, cancellation of the Participant's ticket, refusal of future admission to Events organized by Courtside Society, and the suspension or termination of any privileges associated with attendance at the Event. Courtside Society further reserves the right to pursue all legal and equitable remedies available to it, including recovery of any damages, losses, costs, expenses, investigation costs, enforcement costs, and legal fees incurred as a result of the Participant's conduct or breach, to the extent permitted by applicable law.
No omission, delay, or failure by Courtside Society to enforce any provision of these Terms and Conditions or to exercise any right or remedy shall constitute a waiver of that provision, right, or remedy, nor shall any partial exercise of a right or remedy preclude the subsequent or further exercise of that or any other right or remedy. Any waiver by Courtside Society shall be effective only if made expressly in writing by an authorized representative of Courtside Society and shall apply only to the specific matter for which it is given.
Consent and Marketing Communications
Courtside Society collects, uses, and discloses personal information with your knowledge and consent, except where otherwise authorized or required by applicable law. By voluntarily providing your personal information, registering for an event, purchasing tickets, subscribing to our communications, or otherwise interacting with Courtside Society, you consent to the collection, use, and disclosure of your personal information for the purposes described in this Privacy Policy.
Where required by applicable law, including Canada's Anti-Spam Legislation (CASL), Courtside Society will obtain your express or implied consent, as applicable, before sending you commercial electronic messages, including newsletters, promotional materials, event announcements, exclusive offers, early ticket access opportunities, surveys, and other marketing communications relating to our events, products, and services.
You may withdraw your consent to receive marketing communications at any time by clicking the unsubscribe link included in our electronic communications or by contacting us using the contact information provided in this Privacy Policy. Withdrawal of your consent will not affect the lawfulness of any collection, use, or disclosure of personal information that occurred prior to the withdrawal of consent, nor will it affect communications that Courtside Society is legally or contractually required to provide, including transaction confirmations, event-related notices, safety communications, updates regarding your registrations or purchases, or other service-related communications.
Please note that withdrawing your consent to certain uses of your personal information may limit our ability to provide you with particular products, services, event experiences, or other requested communications where such information is reasonably necessary for those purposes.

Event Photography, Videography, and Media
Courtside Society events are social and public experiences during which photographs, video recordings, audio recordings, livestreams, and other audiovisual content may be captured by Courtside Society or by authorized photographers, videographers, media representatives, content creators, sponsors, or other individuals acting on our behalf.
As part of the operation, promotion, documentation, security, and administration of our events, photographs and recordings may include the images, likenesses, voices, or other identifying characteristics of event participants, attendees, guests, volunteers, contractors, and staff.
Where photographs, video recordings, audio recordings, or other audiovisual content constitute personal information under applicable privacy legislation, Courtside Society will collect, use, retain, disclose, and otherwise process such information in accordance with this Privacy Policy, the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”), and any other applicable privacy legislation.
Subject to applicable law and the terms of any applicable Event Waiver, Media Release, or Terms and Conditions accepted by you, Courtside Society may collect, use, reproduce, publish, display, distribute, transmit, edit, archive, and otherwise use such photographs, recordings, and audiovisual content for operational, promotional, marketing, advertising, editorial, documentary, security, archival, and other legitimate business purposes. Such content may appear on our website, social media platforms, digital and printed promotional materials, newsletters, advertising campaigns, event recaps, press releases, and other media now existing or developed in the future.
Where an individual is prominently identifiable in published content and requests that such content be reviewed, Courtside Society may, in its sole discretion and subject to legal, contractual, operational, or technical limitations, consider requests to remove or discontinue the future use of specific photographs or recordings. However, Courtside Society cannot guarantee the removal of content that has already been published, distributed, shared by third parties, incorporated into promotional or archival materials, or otherwise lawfully used.
Nothing in this Privacy Policy limits, modifies, or replaces any consent, authorization, licence, release, or waiver relating to photography, videography, audio recording, or media use that you may provide pursuant to an Event Waiver, Media Release, Terms and Conditions, ticket purchase agreement, or any other agreement governing your attendance at or participation in a Courtside Society event. In the event of any inconsistency between this Privacy Policy and any such agreement with respect to media consent or usage rights, the applicable Event Waiver, Media Release, or Terms and Conditions shall govern to the fullest extent permitted by law.
Retention of Personal Information
Courtside Society retains personal information only for as long as is reasonably necessary to fulfill the purposes for which it was collected, to provide our products and services, to administer and operate our Events, to comply with our contractual obligations, to resolve disputes, to enforce our legal rights and agreements, and to satisfy applicable legal, regulatory, accounting, tax, insurance, licensing, and record-keeping requirements.
The length of time that personal information is retained depends upon the nature of the information, the purpose for which it was collected, the sensitivity of the information, applicable limitation periods, and any legal or regulatory obligations requiring its retention. Where personal information is no longer required for the purposes for which it was collected and there is no legal or legitimate business reason to retain it, Courtside Society will securely destroy, permanently delete, anonymize, or otherwise dispose of such information in a manner appropriate to its sensitivity and in accordance with applicable law.
Certain information may be retained for longer periods where required or permitted by applicable law, where necessary to establish, exercise, or defend legal claims, to investigate fraud or security incidents, to comply with court orders, regulatory requests, insurance obligations, or governmental requirements, or where retention is otherwise reasonably necessary to protect the legitimate interests of Courtside Society.
Where personal information has been anonymized so that it can no longer reasonably be associated with an identifiable individual, Courtside Society may retain and use such anonymized information for lawful business purposes, including statistical analysis, research, business planning, reporting, and the improvement of our products, services, Events, and website.
Safeguarding Personal Information
Courtside Society is committed to protecting the security and confidentiality of the personal information entrusted to us. We maintain administrative, technical, physical, and organizational safeguards that are designed to protect personal information against loss, theft, unauthorized access, collection, use, disclosure, copying, modification, disposal, or destruction. The nature of these safeguards is appropriate to the sensitivity of the information and is reviewed and updated periodically to address evolving legal requirements, operational needs, and technological developments.
Such safeguards may include, where appropriate, secure information systems, encryption technologies, password protection, access controls, authentication procedures, firewalls, secure payment processing through trusted third-party providers, restricted access to personal information on a need-to-know basis, employee and contractor confidentiality obligations, secure storage practices, and policies governing the handling, retention, and destruction of personal information.
While Courtside Society takes reasonable measures to protect personal information, no method of transmitting information over the Internet, electronic storage system, or security measure can be guaranteed to be completely secure. Accordingly, Courtside Society cannot guarantee the absolute security of personal information, and any transmission of information to or from our website or systems is at your own risk. In the event of a breach of security affecting personal information, Courtside Society will take such steps as may be required by applicable law, including investigating the incident, taking reasonable measures to mitigate potential harm, maintaining any required records of security incidents, and providing notification to affected individuals and regulatory authorities where required.
Participants and users are also responsible for taking reasonable precautions to protect their own personal information, including maintaining the confidentiality of any account credentials, safeguarding their devices, and notifying Courtside Society promptly if they become aware of any unauthorized access to their personal information or any suspected security incident involving their interactions with Courtside Society.
Access, Correction, and Withdrawal of Consent
Subject to applicable law, you have the right to request access to the personal information that Courtside Society holds about you, to request information regarding the collection, use, and disclosure of your personal information, and to request that inaccurate, incomplete, or outdated personal information be corrected or updated.
Upon receipt of a written request, and after verifying your identity where appropriate, Courtside Society will respond within the timeframes prescribed by applicable privacy legislation. Access to personal information may be limited or refused where permitted or required by law, including where disclosure would reveal another individual's personal information, compromise confidential commercial information, interfere with legal proceedings or investigations, be protected by solicitor-client privilege or litigation privilege, or otherwise fall within an exemption recognized by applicable legislation.
Where you establish that personal information maintained by Courtside Society is inaccurate or incomplete, we will take reasonable steps to correct, update, or supplement the information as appropriate. Where required by applicable law, Courtside Society may also notify third parties to whom the corrected information has been disclosed where it is reasonable to do so.
You may withdraw your consent to the collection, use, or disclosure of your personal information at any time, subject to legal, contractual, or regulatory restrictions and upon providing reasonable notice to Courtside Society. Withdrawal of consent will not affect the lawfulness of any collection, use, or disclosure that occurred before the withdrawal became effective. Please note that withdrawing consent may limit or prevent Courtside Society from providing certain products, services, event registrations, communications, or other requested services where the collection or use of personal information is reasonably necessary for those purposes.
Requests relating to access, correction, or withdrawal of consent may be submitted using the contact information set out in the Contact Information section of this Privacy Policy.

Courtside Society does not own, operate, or control the privacy practices, content, security, or policies of any third-party website or service, and assumes no responsibility or liability for the collection, use, disclosure, retention, security, accuracy, legality, or other practices of such third parties.
Your interactions with any third-party website, platform, application, or service are governed exclusively by the applicable terms, conditions, and privacy policies of that third party. We encourage you to review the privacy policies and terms of use of any third-party service before providing personal information or engaging with such service.
Without limiting the foregoing, where Courtside Society utilizes third-party service providers to facilitate payment processing, ticket sales, event registration, website hosting, cloud storage, analytics, marketing, customer relationship management, or other operational functions on our behalf, such service providers are authorized to collect, use, process, store, or disclose personal information only to the extent reasonably necessary to provide the requested services or to otherwise perform services for Courtside Society in accordance with applicable law and their contractual obligations to Courtside Society.
Children's Privacy
Courtside Society's website, products, services, and Events are intended for individuals who have reached the age of majority in their applicable jurisdiction unless expressly stated otherwise. Certain Events may also be subject to minimum age requirements or additional eligibility criteria, including events at which alcoholic beverages are served or where admission is otherwise restricted by law or venue policy.
Courtside Society does not knowingly collect personal information directly from children or minors in contravention of applicable privacy legislation. Where we become aware that personal information has been collected from a child or minor without the consent required by applicable law, we will take reasonable steps to investigate the matter and, where appropriate, delete such information or otherwise address the collection in accordance with applicable legal requirements.
Parents, guardians, or other individuals who believe that a child or minor has provided personal information to Courtside Society contrary to this Privacy Policy or applicable law are encouraged to contact us promptly using the contact information provided below so that appropriate action may be taken.
Nothing in this section limits Courtside Society's right to verify the age or identity of any individual where reasonably necessary to comply with applicable law, including age verification requirements relating to the purchase, possession, or consumption of alcoholic beverages or admission to age-restricted Events.
Changes to this Privacy Policy
Courtside Society reserves the right, in its sole and absolute discretion, to amend, supplement, modify, restate, or otherwise revise this Privacy Policy from time to time in order to reflect changes in its business operations, products, services, Events, technologies, legal or regulatory obligations, industry practices, or applicable privacy legislation.
Any amendment to this Privacy Policy shall become effective upon the publication of the revised Privacy Policy on the Courtside Society website or by such other method of notice as Courtside Society may determine to be appropriate, unless a later effective date is expressly specified or applicable law requires otherwise. The “Last Updated” date appearing in this Privacy Policy shall indicate the date on which the most recent revisions became effective.
Where required by applicable law, Courtside Society will provide notice of material amendments to this Privacy Policy and, where legally required, obtain any additional consent prior to implementing such amendments.
To the fullest extent permitted by applicable law, your continued access to or use of the Courtside Society website, purchase of tickets, registration for or attendance at an Event, use of our products or services, or other interaction with Courtside Society following the effective date of any amendment to this Privacy Policy constitutes your acknowledgment of, and agreement to, the revised Privacy Policy, except where applicable law requires an alternative form of consent.
